Case #1: Refinanced Real Estate
The first case involved a bank that had been working for quite a while on an older judgment. They had given up on collecting the debt and asked us to represent them. This is not unusual by the way. Many of our clients only come to us after having tried in vain to collect on their own.
At any rate, our team conducted an asset search and discovered a piece of real estate owned by the debtor. We contacted the debtor to let him know what we knew. We gave him time to refinance that property, which he did, providing enough cash for him to settle the debt.
Case #2: The Possibility of Legal Action
Our team worked on another case involving a debtor who had been successfully evading a bank for quite some time. His lack of payment obviously did not sit well with our client. Our first task was to locate the debtor. That’s what we did.
Upon locating him, we let him know that we would commence legal action if he did not find a way to make payment. Fortunately for both him and our client, he was able to come up with the cash to satisfy his obligation. No legal action was required.
Case #3: an Airplane Hangar in Another County
The third case study involved a debtor who was both avoiding payment and claiming to not have the resources to settle his debt. Such claims are common, by the way. As we normally do, we conducted an asset search to see if we could find anything to work on.
Our search turned up an airplane hangar in a neighboring county. Armed with that information, we contacted the debtor to let him know we knew about the property. That was enough to motivate him to agree to make payment. He did not want to lose his hangar over the debt.
Common Elements in All Three Cases
Although every case we work on is different to some extent, many have some similarities. Take these three cases. There were common elements in all of them, including the fact that each of the debtors had assets that were jeopardized by their unwillingness to pay their debts.
