Different Types of Judgment Debtors

We have been actively collecting money judgments in Michigan for quite some time. One of the things we have learned over the years is that there are different types of judgment debtors. Not understanding the type of debtor that you are dealing with can further complicate things.

Consider the following judgment debtor types:

  • Ready to Pay – The first type of judgment debtor is ready to pay immediately. This group is everyone’s favorite. Even if these people do not have enough cash to settle their debts immediately, they are willing to enter a payment plan. If only all judgment debtors were in this group.
  • Needs Some Encouragement – The next type of judgment debtor is a person who needs a bit of encouragement. For whatever reason, they do not want to pay or believe they truly cannot afford to. With a little bit of encouragement from the creditor, they can be convinced to settle.
  • Purposely Avoids Paying – Third is the judgment debtor who purposely avoids making payment. They go out of their way to hide assets, furnish incomplete information, and do anything else they can to get out of paying up.

We cannot talk about the different types of debtors without discussing the judgment-proof debtor. This is one type of debtor you don’t want to encounter as a judgment creditor.

More About the Judgment-Proof Debtor

A judgment-proof debtor is a person who legitimately lacks the resources to pay what they owe. They may be unemployed or working a low wage job that doesn’t allow wage garnishment. They may not have any assets of significant value. Trying to collect is like trying to get blood from a stone.

If there is any good news it is the fact that not all judgment-proof debtors remain judgment-proof permanently. Things change. Circumstances can improve. A person who is judgment-proof today could find themself in a higher paying job six months down the road. They might inherit some valuable property. You never know.

Plenty of Obstacles to Overcome

The point of all of this is that there are plenty of obstacles to overcome as a judgment creditor. The more obstacles in your way, the more difficult it is to collect. Obstacles do not bother the Judgment Collectors team. We are used to them. We consider them challenges that make us better at what we do.

On the other hand, we would guess that the collection obstacles you face are enough to drive you crazy. You just want to get paid and put the whole thing behind you. But the more time and money you spend on collecting, the more you feel like you are never going to win.

Collecting judgments in Michigan isn’t always an easy task. Sometimes it can be very complex. But we make the complex simple by collecting on behalf of our clients. If you are ready to simplify things, let us talk about turning your judgment over to us.
